Worth confirming before you buy

Questions for the listing brokerage, your lawyer and your inspector. They are prompts, not conclusions about this house, and not legal advice.

  • The second kitchen and unitThe listing calls the house a duplex with two kitchens. A second unit needs a building permit and must meet the Building Code and Fire Code. Ask for the permits and final inspections, and have your lawyer check zoning. The City’s Property Information Report, a list of building permits on file, does not state permitted use.
  • Notes on the front doorOne photo shows a building-permit notice, a hand-lettered sign that appears to read “legal duplex with permits” and another note that appears to mention a home inspection report, all taped inside the front door. The listing text says only “duplex”. Ask what work the permit covers, whether it was finalized, for proof of anything the sign claims, and for the inspection report if there is one.
  • Bedroom and bathroom countThe listing says four bedrooms in its opening line and its bedroom count, but its floor-by-floor description and room list name three, and the room list names no bathrooms although the listing says two. The photos show several empty rooms that could serve as bedrooms, and two bathrooms. Confirm what counts as a bedroom, and where the second bathroom is.
  • What staysThe appliance list names a dishwasher, two stoves, two refrigerators and a tankless water heater. The photos also show a second dishwasher and two stacked washer and dryer sets. Ask what is included, and whether the water heater is owned, as the description says.
  • ElectricalThe listing names 200-amp service. Ontario’s Electrical Safety Authority (ESA) issues a Certificate of Acceptance, its sign-off for electrical work, and suggests your lawyer order a search of its records. Ask for certificates covering the service and the second kitchen.
  • Fire safetyFor a house with two units, Ontario’s codes call for linked smoke alarms, a fire-rated separation between the units, carbon monoxide alarms where fuel-burning appliances are used, and a safe way out of each unit; details depend on the house’s age and when work was done. Ask for the last inspection results.
  • The lane and a laneway suiteThe listing mentions potential for a laneway suite, subject to the buyer’s own due diligence. Toronto allows one only on a lot whose rear or side line runs at least 3.5 metres (11.5 feet) along a public lane. Greenwood Park, home to the Leslieville Farmers’ Market on Sundays in season, is about an 11-minute walk away, and the shops and cafés of Queen Street East are about a 14-minute walk.
